One of the most unpleasant situations you can face as a traveler is being denied boarding a flight for reasons beyond your control. In this post we will explain in which cases an airline can deny you boarding and what rights you have in this situation.
When can you be denied boarding a plane?
Passengers may be denied boarding under certain circumstances, such as health and safety reasons or the presentation of inadequate documents for boarding.
Another reason is the problems caused by unruly passengers because, for example, they have consumed a large amount of alcohol or show aggressive attitudes. According to data provided by the State Agency for Air Safety in Spain, the number of complaints about incidents arising from inappropriate or conflictive behavior that have caused delays, operational interruptions and, in short, threats to safety has increased considerably.
Denying boarding to a passenger and preventing access is a decision of the ground staff. That is why it is important that airlines prepare their personnel for this decision making, as denying boarding to a passenger is a clear breach of contract by the carrier when there is no cause to justify it.
Can you be denied boarding because of your clothes?
Denying boarding to a passenger because of his or her clothing is discriminatory. It is a different matter if the passenger presents himself/herself for boarding in inadequate conditions (lack of personal hygiene, dirty clothes...).
Airlines may establish dress codes in their regulations, as is the case in other sectors. These codes must be clear and non-discriminatory. For example, passengers should wear clean, neat clothes, avoid sportswear, swimsuits or shorts. Therefore, it is very important that you check the requirements of the airline you have contracted.
How to claim if you are denied boarding without just cause?
You must request that they provide you with the form to fill out the claim and, if you are at the airport for some time until you are rebooked on another flight, you must keep proof of the expenses you have incurred.
If the airline does not respond to your claim, you have the possibility of going to court.
